1. Acceptance of Terms

By downloading, installing, accessing, or using FocusDrive ("the App"), you agree to these Terms and Conditions. If you do not agree, do not use the App.

2. Description of Service

FocusDrive is a mobile app that simulates a driving journey to support focus sessions. It includes:

• Location-based route planning and simulation
• Free access to 10 journey sessions
• Optional pro subscriptions (monthly or lifetime) with unlimited access
• Map-based visualization of journeys

3. Account and Eligibility

• Age: You must be at least 13 years old to use the App.
• Legality: You must have the legal right to enter into these terms and use the App.
• No transfer: Accounts are non-transferable and for personal use only.

4. Location Services

• The App requires location access for routing and journeys.
• You grant permission to use your location for these features.
• You can revoke permissions anytime; this will limit functionality.
• Your location data is processed locally and is not shared by us with third parties.

5. Free Trial and Usage Limits

• New users receive 10 free journey sessions.
• Each started session counts toward this limit unless you have a Pro subscription.
• Free uses cannot be reset, transferred, or refunded.
• You are responsible for staying within these limits.

6. Pro Subscriptions

6.1 Subscription Plans

• Monthly Subscription: Auto-renews monthly.
• Lifetime Subscription: One-time purchase with lifetime access.

6.2 Payment Terms

• Payments are processed via the App Store per its terms.
• Prices are displayed in your local currency.
• Pricing may change; existing subscribers retain their current rate unless otherwise stated.
• All purchases are final, subject to refund policies below.

6.3 Auto-Renewal (Monthly Subscriptions)

• Subscriptions auto-renew at the end of each period.
• Manage/cancel via the App Store subscription settings.
• You are charged automatically if not cancelled at least 24 hours before renewal.
• Cancellation does not affect the current period.

6.4 Lifetime Access

• Lifetime subscriptions grant ongoing access to Pro features during the App’s operation.
• "Lifetime" refers to the App’s operational lifetime, not your personal lifetime.
• If the App is discontinued, lifetime access may no longer be available.

6.5 Subscription Termination

• You may cancel anytime in App Store settings.
• Cancellation takes effect at the end of the billing period.
• Refunds are subject to App Store and local laws.
• We may suspend or terminate subscriptions for violations of these Terms.

7. Refund Policy

• Please contact the App Store for refund requests.
• Free trials and free journeys are not refundable.
• No refunds for partially used subscription periods unless required by law.
• Technical issues will be addressed to restore service where possible; refunds may be considered at our discretion.

8. Intellectual Property Rights

• The App (including code, design, graphics, logos, and content) is owned by us or our licensors.
• You receive a limited, non-exclusive, revocable license to use the App for personal, non-commercial use.
• Do not reproduce, distribute, modify, create derivative works, sell, or commercialize any part of the App without permission.

9. Third-Party Services and Content

The App may include third-party services and content, including but not limited to:

• Apple MapKit for mapping and location services
• RevenueCat for subscription management
• OpenWeatherMap for weather information

We are not responsible for the availability, accuracy, or practices of these services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

IMPORTANT: The App is for entertainment and focus purposes only and is not intended for use while operating a vehicle.

12. Indemnification

You agree to indemnify, defend, and hold harmless FocusDrive and its owners, employees, and partners from any claims, damages, losses, liabilities, and expenses arising from your use of the App or violation of these Terms.

13. Privacy

Your use is also governed by our Privacy Policy. By using the App, you consent to our data practices described therein.

14. Changes to Terms

We may update these Terms. Material changes will be communicated through the App or via email. Continued use after changes indicates acceptance. If you disagree, stop using the App.

15. Termination

• You may stop using the App and delete it at any time.
• We may suspend or terminate access for violations of these Terms.
• Sections on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

16. Governing Law and Dispute Resolution

• These Terms are governed by [Your Jurisdiction] law, without regard to conflict of law principles.
• Disputes: For EU users, or if required by local law, you may have the right to bring claims in your local jurisdiction. Otherwise, disputes will be resolved through binding arbitration or in the courts of [Your Jurisdiction].

17. Apple-Specific Terms

If accessed through the App Store:

• These Terms supplement App Store terms. In case of conflict, App Store terms govern.
• Apple is not responsible for the App or its content.
• Apple provides no warranty and has no obligation to provide support.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.

18. Severability

If any provision is invalid or unenforceable, the remainder of these Terms remains in effect to the fullest extent allowed.

19. Entire Agreement

These Terms constitute the entire agreement concerning the App and supersede prior communications.
